The deadline is Wednesday eveningThe USDA issued an Interim Final Rule (IFR) entitled “Establishment of a Domestic HempProduction Program” to establish regulations for hemp farming as required by the 2018 Farm Bill.

We have carefully reviewed the IFR and identified some serious flaws that need to be corrected in order to ensure that farmers can grow hemp successfully.

We have a number of recommendations in our comments that ensure accuracy and fairness in the program including:Including sampling and genetic variation in the Measurement of Uncertainty Requiring the entire plant to be sampled to ensure accurate THC results

Increasing the sampling to harvest window from 15 to 45 days

Simplifying disposal of non-compliant plants and removing DEA from the process

Getting rid of the unnecessary requirement that labs be registered with DEARemoving the provision that makes crops that test >4.9% as negligent violation

The Differences in CBD Oils

In this article I would like to discuss the differences in CBD oils in the market! In recent years CBD(Cannabidiol) use has skyrocketed. The ways you can ingest it are as diverse as the myriad of products out there!

You can take it sublingual which was the accepted way for centuries. In 1870 the most popular medicine on the shelf in the Apothecary was Cannabis Oil and it was prescribed for a plethora of reasons. In today’s world you can eat your CBD when infused into edibles, you can vape the oil, which is becoming more and more popular as you can vape it and mix the CBD oil with Nicotine vape juice, you can use it topically in creams or patches, and I have even seen an Anal delivery method! Along with that there are several kinds of oil. There is Full Spectrum, Multi Spectrum and Isolate. We’ll go over them later in the article. Each one has its own set of benefits and will vary from person to person.

Full Spectrum

New methods of delivering the CBD to our system are always being experimented nowadays as everyone is looking for the best method to deliver. As I mentioned there are different types of oil. The industry standard for centuries, Yes centuries, lol, was the Full Spectrum Extract known as Cannabis Oil. In the Old West in the USA it was referred to by many a traveling salesman as Snake Oil! “Good for what ails ya”. The full spectrum Cannabis oil extracted with solvents can be made from RAW cannabis or Activated Cannabis. More on that later. For all intents and purposes you can consider the full spectrum oil to have all the compounds in the plant you are extracting from. For centuries this was considered the the Holy grail of medicine as it had effects on so many discomforts and ailments.

Multi Spectrum

Then there are the Multi Spectrum extracts which are done with varying types of extraction, most of which use pressure and heat. The amount of heat and pressure determines which compounds are being extracted. They have some of the compounds that come out at the same pressure and heat, typically Terpenes. These are used for different purposes and usually is dependent on individual  tastes and comfort.

Isolate

And finally we have the “Isolate” This has become very popular as the extraction processes have become better and better. In 2014 the best method of extraction was CO2. It is very efficient and you can pinpoint the exact pressure and temperature to isolate the one compound. The problem with pressure extractions is some of the molecules are broken. Even though they will test as being there say 1000 mg of CBD. Only 50% of it might be Bio-available. Bio-availability is the most important thing! This my personal favorite of all. I combine the CBD isolate with my medical marijuana increasing the health benefits of using cannabis as a healing medicine.

So people are not only confused about which kind of oil will be effective for them and what to buy but which oil which way? You can consume any of the oils in any of the delivery methods. What you need to be careful with is that you get the CBD differently with each different method and oil. Sublingually by vaping is considered the best and most Bioavailable method to deliver the CBD. This seems to be better than sublingual oil as most people end up swallowing half or more of the oil then digesting it which you get it much slower to your blood system thru your digestive tract.

Actually, medicinally under a doctors care, intravenous delivery is possible. But back to us. The only problem with vaping is not everyone wants to vape all that much all day. Some people use upwards of 100 or more mg of the oil sublingual a day and the proponents of vaping say vaping is eight times more bio-available. That would mean you only have to vape 12 to 15 mg as opposed to 100 mg of sublingual oil. For a smoker that is nothing but if you don’t already vape it’s a lot! And now there are full spectrum vapes, multi spectrum vapes and isolated vapes LOL. The choices can be daunting. Keep in mind that isolated CBD is different from full-spectrum CBD extract or multi spectrum in that it only contains CBD and none of the other cannabinoids, terpenes, or healthy fatty acids that commonly result from the from the whole-plant extraction process.

Beware of all the vapes on the market. Make sure it is a reputable company and is being reviewed by third parties as there is a lot of junk out there right now!

100’s of active cannabinoids

Cannabis, with its complex chemical structure, contains 100’s of active cannabinoids aside from CBD. It also contains terpenes, which have anti-inflammatory properties, and are regarded as increasing the efficacy of cannabinoids. Kind of like an enhancer. Although they are not rated as important as CBD when it comes medical benefits, some of these other cannabinoids have been found to have symptom alleviating qualities as well. The cannabinoids CBN and CBG for example, are found in most full-spectrum extracts and studies have shown that both contain anti-inflammatory, anti-bacterial, and pain relieving properties. So a few years ago I was sure I wanted Isolated CBD but now as the science gets better I for one am going to try a full spectrum oil.

Whole-plant Extracts

Whole-plant extracts typically contain a carefully measured amount of the cannabis plant’s most prominent cannabinoid, THC, and it all depends on the plants DNA. In many countries, a certain percentage of THC is illegal, so it is vital to know the amount of this cannabinoid when manufacturing products that contain full-spectrum CBD. When present together, CBD and its cannabinoid colleagues, as well as terpenes, produce what is known as an entourage effect. The synergistic relationship between cannabinoids and terpenes has been shown to increase the healing properties of each. In the US the threshold is .3% THC in the live plant. This is how the law reads but you will still see oil on the market that says the oil contains less than .3% THC which is bending the regulation a bit!

A study published by the Lautenberg Center for Immunology and Cancer Research,(https://providahealth.com/2018/03/23/cannabis-study-full-spectrum-cannabis-extracts-medically-effective-cbd-alone/) which aimed its focus on the effectiveness of CBD isolate compared to full-plant extract, supported the concept of full spectrum extracts, stating in its summary that “in all of the tests, the isolated CBD was ineffective both before and after a certain dosage, while the effectiveness of the full-spectrum solution continued to increase as higher doses were administered. The results all indicate that CBD is only effective against swelling and pain at a certain dose, and that cannabis solutions containing a full range of cannabinoids will continue to provide corresponding effects as the dosage is increased.” Given the results of this study, it would seem to confirm that full-spectrum extract is preferable over CBD isolate for most CBD users, but CBD isolate is still frequently used and believed by some to be more effective than full-plant extract.

This belief is led by the idea that CBD is the only medically sought after cannabinoid in the cannabis plant, aside from THC. Many CBD isolate users are under the impression that by consuming only the CBD cannabinoid and no terpenes or any other “unnecessary” components of the plant, they are getting a more powerful or effective dose of CBD. When vaping a CBD extract, which as stated previously, is considered to be the most efficient and quick-acting method of administering CBD, isolate users may feel that they are taking the most efficient route to CBD consumption. While this method might be efficient, the lack of entourage effect means the benefits are reduced when compared to full-spectrum CBD consumption. This is all new and I am an ISOLATE user so here I go PRACTICING again.

CBD Isolate Does Have Something To Offer

However, CBD isolate does have something to offer CBD users that full-spectrum extracts does not. The fact that full-spectrum extracts invariably contain low levels of THC means that some users prefer to play it safe and stick to pure CBD by itself, out of fear of failing a drug test or experiencing a form of “high”, although both of these occurrences have been found to be fairly unlikely.

THC is one of the cannabinoids involved in the “entourage effect” stated earlier so it is ideal for inclusion in CBD supplementation. A recent article on full-spectrum CBD demonstrates the importance of THC inclusion by stating, “In hemp THC is a minor constituent and appears only in trace amounts under 0.3% by dry weight, as required by the U.S. government for hemp products. THC mimics the action of anandamide, a neurotransmitter naturally produced in the human body, and binds to CB1 receptors in the endocannabinoid system found mostly in the brain. The extremely low levels of THC in hemp make hemp oil non-psychoactive and safe for all ages to use.”

The wide range of benefits contained in full-spectrum CBD extracts means some CBD merchants have either ceased to sell, or scale down the promotion of CBD isolate, in comparison to the whole-plant extract variety. Companies and individuals who extract CBD themselves are realising that cannabis has more to offer medicinally than just CBD or THC, and that there is little to no reason to not include all that this “super-plant” has to offer in the extraction process.

Healthier You and Me

With all that said there is a lot to be benefitted from the THC free variety of cbd hemp oil. Isodiol has developed a way to make a full spectrum extract that has even the trace amounts of THC removed. Many people have an aversion to any kind of THC. So industrial hemp and the new science may be the way to a healthier you and me!

CBDA and THCA

Going back to something I said earlier that I would like to explain. The difference between raw cannabis CBDA and THCA and activated CBD and THC. There are NO psychoactive properties to RAW Cannabis. It is considered a Super Food! In order to change CBDA to CBD and THCA to THC it must be heated (decarboxylated) in order to activate either compound. So if you are a healthy person and just looking to pump up your system go for the Full Spectrum Raw Cannabis Oil.

Constant Evolving Market!

This all serves to underline the importance of testing CBD extract for the various levels of active ingredients. If your homemade CBD extract contains a high amount of THC it could be illegal in your country and require you use either a different method of extraction, or more likely, the need to find a source of hemp that has lower THC. As more scientific literature emerges supporting the entourage effect, and increased benefits of full-spectrum CBD compared to CBD isolate, we can expect the manufacture and sale of CBD goods based around isolate and the other spectrums to be a constant evolving market!

Support for US Cannabis Legalization Reaches New High

Americans say Cannabis should be legal.
The support for US Cannabis legalization reaches a new high exposing a national shift as more states legalize cannabis for medical or adult use.

Americans Support

In an unprecedented move Americans support for legal Cannabis was 61 percent in 2018, a rise from 57 percent two years ago, according to the General Social Survey, which is a respected trend survey that has been measuring support for legal Cannabis since the 1970s.

The General Social Survey has been conducted since 1972 by NORC at the University of Chicago, primarily using in-person interviewing.

Sample sizes for each year’s survey vary from about 1,500 to about 3,000 adults, with margins of error falling between plus or minus 2.2 percentage points and plus or minus 3.1 percentage points.

The most recent survey was conducted April 12 through Nov. 10, 2018, and includes interviews with 2,348 American adults.

As of 2019, Legal Cannabis Has Created 211,000 Full-Time Jobs in America

An analysis of the survey by The Associated Press-NORC Center for Public Affairs Research and the General Social Survey staff finds that increased backing of legalization cut across all age groups and political parties. The 2018 poll is the first in which a majority of Republicans support legalizing marijuana — 54 percent, up from 45 percent in 2016. Among Democrats, 76 percent now favor legalization. Even the political venue is starting to come around and see that the fruits of ending this needless prohibition of HEMP in general far outway any negative effects!

I have been involved with NORML since the seventies. I have been a proponent of ending the prohibition on Cannabis all my adult life. I for one have suffered the legal consequences of civil disobedience. Daddy always taught me “don’t play unless you can pay”!

The rising support mirrors the evolving legal landscape across the country. Most Americans now live in places where marijuana is legal in some form, with 10 states allowing recreational usage and more than 30 allowing medicinal use.

The GSS asks about making use of marijuana legal, but does not specify whether it should be legal for recreational or medical use. What they are really concerned with is how do they control it?

Legalization advocates say the increasing public support should prompt the U.S. government to reverse course. At the federal level, marijuana is categorized as a dangerous illegal drug, similar to LSD or heroin. It is totally evident with all the positive effects being reported that the scheduling was wrong. Cannabis irrefutably has medical benefits and recreationally is not as dangerous as alcohol or tobacco. What it comes down to is that the government does not have the right to control something that was lied about.

“Our time has come,” said Justin Strekal, political director of the National Organization for the Reform of Marijuana Laws, or NORML. “Never in modern history has there existed greater public support for ending the nation’s nearly century-long experiment with marijuana prohibition.”

Support for legalization is strongest among 18-to-34-year-olds, with nearly 75 percent favoring it.

But older Americans are taking a more favorable view, too. Forty-six percent of those 65 and older say marijuana should be legal, up from 42 percent in 2016. Views on marijuana legalization have shifted dramatically: In the 1973 GSS, just 19 percent supported legalization.

Look at those numbers! How can our elected officials deny this! And I do believe that they are not asking the right baby boomers lol. I see it more as almost everyone I talk to says it should be legal whether they use it or not!

The change in Americans’ views about cannabis can also be witnessed on the campaign trail. A growing list of Democratic presidential contenders want the U.S. government to legalize marijuana, including California Sen. Kamala Harris, a former prosecutor whose home state is the nation’s largest legal pot shop, and New Jersey Sen. Cory Booker, a prominent legalization advocate on Capitol Hill. Even retired Senators and representatives are jumping on the boat to be in front of this movement when legalization inevitably happens.

Support for legalization has been gradually growing for years, but it has increased sharply since 2012, when Colorado and Washington state became the first states to legalize the recreational use of cannabis. Now other states and even the District of Columbia, our nation’s capital have legalized the use for adults. How ironic is that? Our leaders live where it’s legal but want to control us?????


United States Attorney General William Barr

We have a new Attorney General in the United States, William Barr and he said during a Senate hearing that he would prefer Congress pass the STATES Act—a bill to let states legalize marijuana—than continue the current approach of states ending cannabis prohibition contrary to federal law. He also said he’s not sure if Cole Memo protections should apply to cannabis businesses that started operations after his predecessor Jeff Sessions rescinded it, though he won’t go after those who were operating under its protections before then. And, he pledged to act on pending applications for licenses to grow cannabis for research. All praise that sessions is gone and a reasonable person has taken his place. So far this AG has met or exceeded my expectations.

Other politicians speaking out on the subject and proposing bills to end the prohibition are:

Sen. Cory Booker (D-NJ), a presidential candidate, tweeted, “There’s a lot of talk about the legalization of marijuana. It’s about time. But there’s not nearly enough talk about restorative justice to lift minority communities gutted by the war on drugs.”

Sen. Cory Gardner (R-CO) said he’s “glad Attorney General Barr today reiterated his belief that the current situation is untenable and that the STATES Act is an approach he would be interested in pursuing, and I hope my colleagues will hear his loud and clear call for Congress to act.”

Rep. Lou Correa (D-CA) tweeted about “importance of medical cannabis for our #veterans. 68,000 vets are addicted to opioids. We must research better ways to treat PTSD, TBI, and chronic pain. Our vets deserve it.”

Rep. Earl Blumenauer (D-OR) tweeted, “Even [Attorney General William Barr] knows the prohibition of cannabis is senseless. We must build upon the momentum!”

I could go on and on with the statements, tweets and bill proposals but you get the point. The government is coming around and can see that change is needed. Between state Legislatures and the federal Congress there are over 1000 bills proposed to change the way we handle Cannabis!

Home Values Increase

I saw an article in a science and health magazine that revealed:
cities that allow retail dispensaries saw home values increase $22,888 more than cities where marijuana is illegal from 2014 to 2019 (controlling for population and initial home values).” That is so very cool! It is a sociological phenomena happening across the country. Those cities crime rates are down, opiod deaths are down, DUI has slowed per capita and people are nicer to each other. Go figure????

  Legal marijuana sales in North America reached $9.2 billion in 2017. The legal cannabis market is expected to soar to $24.5 billion by 2021, according to Arcview Market Research.

One of our largest problems in The Cannabis sector is banking. Marijuana is still illegal at the federal level and that’s who regulates banks and they do not want the problems.

That troubling situation inspired  a California Democrat, Hertzberg –  who represents Los Angeles’ San Fernando Valley, to introduce SB 930 to the California Legislature in April. The bill allows for the creation of limited charter banks and credit unions to service cannabis businesses at the state level. It would also allow marijuana firms to use special purpose checks issued by these institutions to pay for state and local taxes, rent, and goods and services.

The law, which has bipartisan support, aims to have cannabis firms store their cash in the vaults of some of the 914 bank branches in the state that have closed since 2014. What an amazing idea. Repurpose existing infrastructure!

SB 930 will still have to clear some procedural hurdles before it’s in front of the full Senate for a vote, but this is definitely another step in the right direction to ease the logistical burden – and enormous public safety concern – that dealing in all cash poses on cannabis businesses. SB 930 is yet another piece in the fight against the federal government’s unjust war on cannabis. Eventually the final blow will have to come from the federal government, but in the interim California, along with many other states, will continue to lead the way.”

Update 03/19

It looks like we have another major surge in the Cannabis space as the Florida Legislature has approved the smoking of cannabis in the Medical Marijuana space. Ever since the amendment passed in 2016 smoking Cannabis has been illegal. Vaping, using it sublingually or topically were the only delivery methods. Recently Anal was added but i don’t see a big increase of use of that delivery method. But smoking, Yes you will see a big increase of the amount of Cannabis being used. It is a fact that some people can only get relief from smoking the herb. Science has shown that different compounds act different under a combustible action as opposed to vaporizing  or absorbing.

Governor DeSantis signed the bill already and it will go into effect shortly. There was a final give from the proponents of the free market system at the end which I believe the good ole boys in Tallahassee just put in so they can say “look we are really in control” lol.

Tobacco papers and blunts will not be allowed.

What???? Somebody’s brother in  law must make pipes is all I can figure. All joking aside this is a move in the right direction.

The closer we get to Legalization the better!

Back in June 2018 as New York state made moves to go legal, the once-staunch prohibitionist Gov. Andrew Cuomo has reversed course and come out in favor or recreational cannabis. It’s amazing how the thought of revenue can change a politicians mind.

Now, we’re getting some more good news from this hugely populated state.

The New York Department of Financial Services has decided against imposing any regulatory action against banks that work with companies in the medical marijuana industry. An awesome move on their part!

That makes sense.

In some cases, New York companies are paying their employees with envelopes stuffed with cash – and their taxes as well. That’s according to Maria Vullo, the New York state superintendent of financial services. I really don’t understand the trouble with that except the fact the government has trouble tracking your movement of cash.

A high NY State financial official wrote “None of this is necessary,”  in a guidance to the state’s financial institutions issued July 3. “Positions taken by the federal government are only exacerbating these problems, rather than remedying them. New York must act.” A call to action to keep the cash moving in the Empire State.

It seems as N.Y. Is on the right track they are definitely having troubles coming to a Final Conclusion on just how to do this Recreational Marijuana thing. The Governor of NY thinks in theory like many of his socialist counterparts. In the government workings there must be a HOW included in the law. I for one am for the total FREE market! The governments should do their specified jobs. The Federal Government is only responsible for inter-state commerce so each state has to come up with their own HOW. Safety is what government should regulate. Making sure there are no bad chemicals, that production facilities are safe and all that but use should be up to the individual in the privacy of their own home! Growing for personal use should definitely be legal!

The six-month Health Department study, commissioned by Cuomo, was released in July and determined that the benefits of legal marijuana outweigh the risks. The department also determined that legalizing the drug for New Yorkers older than 21 would not significantly raise smoking rates and could help reduce racial disparities in police enforcement. Medical marijuana remains legal in New York State for patients who are certified by medical practitioners as having serious conditions, under the Compassionate Care Act. The conditions include cancer, AIDS and severe chronic pain among other ailments.

It doesn’t look like it will be in the budget the way the governor wants but it could change any day. NY is one of that very very political states where revenue is sometimes as important as control! But he still has the support of the Mayor of New York City as shown in this quote “We have a once-in-a-generation opportunity to get a historic issue right for future New Yorkers,” de Blasio said in a letter attached to the report. “Legal cannabis is coming to New York State.”

We’ve talked a bit about how the federal prohibition against cannabis is hindering the banking abilities of marijuana firms in the United States – but it doesn’t stop there. It has global impacts!

This archaic U.S. policy doesn’t only impact Cannabis businesses at the state, or even national, level. In fact, the 2001 USA PATRIOT Act, specifically Section 319(b), allows the federal government to seize what it considers “illicit funds” by issuing subpoenas to any foreign bank that maintains a correspondent account in the United States.

In other words, any bank that deals with a Cannabis firm – even one that resides in fully legal Canada or Uruguay – and that has a banking relationship with a U.S. bank to conduct cross-border transactions could be considered a money launderer according to the PATRIOT Act.

That basically covers almost any major bank in the world, according to a report on the topic coauthored by the Brookings Institution’s John Hudak.

In practical terms, Canadian cannabis firms do have access to local banks, like Alterna Savings, which acts as the bank for at least one of the companies on the list you received if you signed up for my email list., Canopy Growth Corp. (Nasdaq: CGC). The Bank of Montreal also helped financing deals with Canopy and other Canadian marijuana firms. A great sign that the Canadian government and business institutions are all embracing their legalization wholeheartedly!

And so far, the United States hasn’t gone after any American banks with correspondent relationships to foreign banks that work with cannabis firms, according to Cannabis Wire . But this is an issue an issue worth watching.

The President’s Favored Bill

Now, the obvious step that cannabis firms in the U.S. need to take to shore up their basic banking abilities is a change to federal law. And this year has seen a virtual whirlwind of bills getting proposed by various members of Congress.

In fact, there have been 41 pro-cannabis bills introduced this year eme number that lawmakers submitted from 1999 to 2015, according to a Marijuana Business Daily analysis. With the most liberating ones coming as I write.

It’s surely a sign lawmakers are feeling the heat from constituents who support legalization in some form or another. Some, like Senate Majority Leader Mitch McConnell of Kentucky, who is looking to legalize industrial hemp in the latest farm bill, are changing their minds due to the potential positive economic benefits that legal marijuana is bringing to their states. Also they are realizing that Hemp should not be lumped in with Marijuana. Kentucky is already producing and selling industrial hemp oil illegally under the 2010 Farm Act which gave the States the right to grow industrial hemp for research. Well it didn’t take long for the industry to realize the monetary windfall from this amazing plant. They are in defiance of Federal Law just as other states like California, Oregon and Colorado are doing the same thing.

Of course, some of these bills have little chance of making the grade, such as Senate Minority Leader Chuck Schumer’s decriminalization bill. It is very optimistic and would take some real politicking to win over enough votes but we shouldn’t not support it! We should get behind every effort to get rid of CANNABIS PROHIBITION!

But one in particular has a good chance of making it out of committee. Now, this bill not only happens to be supported by a bipartisan group of backers, but even President Donald Trump says he’s supporting it.

And if it passes, it’ll bring relief to cannabis companies’ banking woes…

I’m talking about the STATES Act, S.3032 and H.R.6043, which would essentially leave the states the option to legalize cannabis as they see fit, ending the federal prohibition on cannabis.

Sponsored by Republican Sen. Cory Gardner of Colorado, the bill would “eliminate the basis for a subpoena if the bank was acting in accordance with state law,” according to a spokesperson for Democratic Sen. Elizabeth Warren of Massachusetts, who’s also sponsored the STATES Act.

If it passes Congress – and if President Trump signs it, as he’s suggested he will – any legitimate cannabis firm will be able to use the banking system that virtually all other American companies now take for granted. This is truly what should happen. The stigma of POT  is gone!
